Legal Process Policy
This policy is a structural placeholder pending counsel review before first public launch.
1. Scope
This policy describes how Fitquency responds to legal requests for user data — subpoenas, court orders, search warrants, and other lawful demands from law enforcement or civil litigants. It applies to every account on the platform and supplements the Privacy Policy.
2. What we require before disclosing
- A valid legal instrument issued under applicable law and properly served on Fitquency.
- A request that is specific about the account(s) and the categories of data sought. We ask for narrowing when a request is overbroad.
- Review by Fitquency's designated legal reviewers before any data is released. Emergency requests (imminent risk of death or serious physical injury) follow an expedited review with the same record-keeping.
3. How access is controlled
- Access to protected content is time-limited and approved through a two-person process; no single administrator can grant it alone.
- Every step — filing, approval, key release, each fetch, expiry or revocation — is written to an append-only audit log that no one can edit or delete by hand. Each entry is kept for one year, then deleted automatically.
- Staff who act on a request are recorded internally but are not identified to the account holder by name.
4. Notice to you
We notify the account holder by push notification and email when access under a legal request is approved, unless a court order legally prohibits notice. Where notice is prohibited, it is deferred and provided once the prohibition lapses. The record of every request against your account — what was requested, when, and what happened — is available to you in Settings → Privacy → Legal-hold audit for the year it is kept.
5. What we do not do
- We do not sell user data or grant standing access to any government body.
- We do not respond to informal or unverified requests.
- We do not provide encrypted content we do not hold the keys for.
6. Transparency and contact
Legal process should be served on Fitquency's registered agent. Questions about this policy can be sent to privacy@fitquency.com.
